ZMUni Compliance Centre has recently assisted multiple Chinese cosmetic companies in successfully completing regulatory notifications for the export of cosmetics to the European Union, the United States, Vietnam, Singapore, Malaysia, and other markets.
The product categories cover a diverse range of cosmetics, such as skincare items with moisturizing, cleansing, anti-aging, and brightening functions, as well as makeup and hair care products.
*CNH (Cosmetic Notification Holder): The CNH must be a company or legal entity registered in Malaysia, with a permanent business address and registration with the Companies Commission of Malaysia (SSM). Additionally, its Memorandum and Articles of Association must explicitly state activities related to health and/or cosmetics.
*Product Notification: Valid for a period of 2 years.

*Vietnam RP: Refers to the organization responsible for placing the cosmetic product on the market, typically a local manufacturer or importer based in Vietnam.
*Product Notification: Valid for a period of 5 years.

*Singapore RP: Must be a company registered with the Accounting and Corporate Regulatory Authority (ACRA) of Singapore, typically a cosmetic manufacturer, importer, distributor, or retailer.
*Product Notification: Valid for one year.

*Responsible Person (RP): The manufacturer, packer, or distributor of a cosmetic product whose name appears on the product label, as defined under MoCRA.
*U.S. Agent: A person or business entity that resides or maintains a physical place of business in the United States and is authorized to act on behalf of a foreign facility.
*Facility Registration: Must be renewed every two years, or updated promptly if any submitted information changes.
*Product Listing: Must be updated annually, or sooner if there are any changes to the product information.

*Note: The United States currently does not issue official certificates or provide a public database for cosmetic facility registrations or product listings.
Product Notification Procedure:
*EU RP: Must be an entity established within the EU, typically the cosmetic product’s manufacturer, importer, distributor, or an authorized representative.
*Product Notification: No expiration period; however, any changes to the product information require a new notification.

*Note: The EU does not offer a public database for cosmetic product notifications or manufacturer registrations. Information submitted via the CPNP is only accessible to authorities, poison centres, and Responsible Persons.
