This Month at China: Cosmetic Regulatory Updates in September 2023

1. On August 31, 2023, The Technical Guidelines for Children Cosmetics was newly issued and implemented by China National Institutes for Food and Drug Control (NIFDC). The Guideline provides further guidance on requirements for children cosmetic ingredients and products in the Chinese market, such as product names, formulations, standards, labeling, testing and safety assessment data.

2. On September 1, 2023, the first regulation on the Supervision of Cosmetic Online Operations came into effect which was released on April 4, 2023. 

3. On September 1, 2023, China implemented the updated National Food Safety Standard Restricting Excessive Packaging for Foods and Cosmetics (GB 23350-2021), which stipulates detailed packaging requirements for 31 categories of foods and 16 categories of cosmetics compared to the current requirements.

4. On September 4, 2023, the Guidelines for Submitting Information through the Cosmetic Ingredient Safety Information Registration Platform was approved by China NIFDC. Since January 1, 2024, the cosmetic registrant and notifier shall submit the ingredient safety information documents for all ingredients used in the product formula per relevant regulations and technical specifications.

5. On September 4, 2023, China NIFDC finalized Technical Guidance on Ingredient Safety Information Filling and Submission, which outlines requirements for submitting ingredient safety information and gives instructions on handling changes to ingredient safety information.

6. On September 4, 2023, China NIFDC implemented Technical Guidelines for Filling in and Submitting Cosmetic Formula, which is applicable to guide the filling and reporting of the formula of cosmetic products, including the requirements of the ingredients, the form of filling in the formula, the name and content of the raw material, the main purpose of use, the filling of the remarks column of the formula table and the filling of the safety information of the raw material. 

7. On September 15, 2023, China restored the use of previously obtained submission codes for compound ingredients, which was prohibited before as 180,000 compound ingredient submission codes would be no longer in force.

8. On September 22, 2023, The Cosmetics Registration and Notification Information Service Platform added a new "toothpaste user" submission channel, previously only cosmetic and new ingredient users were available. This means the notification/filing for toothpaste products in China has officially entered a new era.

9. On September 25, 2023, China NMPA issued an announcement on matters related to the implementation of toothpaste regulations and the simplification of filing data requirements for toothpaste already available in the market. Relevant materials should be submitted before Dec.1, 2023, including:

10. Local news: Guangzhou AMR issued some FAQs related to soaps answering questions like Does soap meet the definition of cosmetics? Does soap implement registration and filing management refer to cosmetics? Do "liquid soap" and "soap liquid" are cosmetics?

11. Local news: some cities in China like Guangzhou, Shenzhen and Hangzhou further encourages enterprises with relevant funds to obtain registration and notification license for new ingredients and cosmetics for special uses.
