Regulatory Approach of Novel Food in Thailand

In Thailand, novel food is classified as a specially controlled food and requires approval from the Thai Food and Drug Administration (TFDA) to be legally marketed in Thailand.

 

According to Section 5(1) and Section 6(3), (9), and (10) of the Thai Food Act B.E. 2522 (1979), the Ministry of Public Health of Thailand issued Announcement No. 376, B.E. 2559 (2016) Re: Novel Food. It clearly defines the novel food, the process for safety assessment and its regulatory body, quality standards, methods of use, maximum permitted consumption, labeling, and identification. The importation of novel food is subject to the same regulations.

 

Definition of Novel Food in Thailand

According to B.E. 2559 (2016) Re: Novel Food, the definition of new food ingredients must meet one of the following criteria:

 

  • Any substance used as food or food ingredient with a consumption history in Thailand of less than 15 years.
  • Any substance used as food or food ingredient that utilizes a new production process not widely used at present, and this new process significantly alters the composition or structure of the food, affecting its nutritional value, metabolism, or content of harmful substances.
  • Any food containing the above-mentioned (1) or (2) as an ingredient.

 

Applicant for Novel Food in Thailand (Entity)

The applicant should be a company based in Thailand. Foreign companies may choose to establish a local company in Thailand or entrust a domestic company in Thailand to apply.
