China Customs Releases Draft Measures on Cosmetic Imports and Exports for Public Comment

On May 22, 2024, the General Administration of Customs of China (GACC) released the Measures on the Inspection, Supervision, and Administration of Import and Export Cosmetics (Draft for Comment) (hereinafter referred to as Measures). This initiative aims to ensure the quality and safety of imported and exported cosmetics, protect consumer health, and promote the high-quality development of the cosmetics industry. Public comments are welcome until June 22, 2024.

 

Initially implemented on February 1, 2012, this Measures have played a crucial role in standardizing the supervision of cosmetic safety for imports and exports. Following institutional reforms, the Measures were amended in April, May, and November 2018 under Customs Orders No. 238, 240, and 243.

 

In 2021, the newly amended Cosmetic Supervision and Administration Regulation (hereinafter referred to as Regulation) was enacted. This Regulation introduced stricter controls on the cosmetics industry, emphasized the responsibility of producers and operators for quality and safety, clarified the obligations of importers, and increased penalties for violations.

 

Furthermore, to improve the business environment at ports, GACC abolished the filing requirements for exporters' manufacturing enterprises and importers' domestic consignees, as per Announcements No. 99 (2020) and No. 108 (2021).
