China Cosmetic Regulatory Updates

Additionally, the previously filed new ingredient "Asciquorp" by Amorepacific Corporation has been canceled as of February 1st, making it the first ingredient to be canceled. The reason for the cancellation has not been disclosed at this time.

Regulations & Policies

On February 4, 2024, China NMPA issued a notice regarding the 2023 national cosmetics sampling inspection. It was found that three batches of cosmetics, including Yubei Chubao Baby Summer Soothing Lotion, which were labeled as manufactured by Jiangxi Zhi'en Tang Industrial Co., Ltd., did not comply with regulations. These products underwent testing conducted by the Jiangxi Provincial Institute for Drug Control and Testing and other organizations, revealing the presence of prohibited ingredients as specified in the "Safety Technical Specification for Cosmetics (2015 Edition)."

 

On February 5, 2024, the China National Institutes for Food and Drug Control (NIFDC) took further steps to standardize and guide the safety evaluation of cosmetics and ingredients. They issued a notification introducing five technical guidance principles, including the "Guiding Principles for Acute Inhalation Toxicity Testing of Cosmetic Ingredients." Read the previous report here.

 

On February 20, 2024, the Guangzhou Municipal Administration for Market Regulation released the "FAQs on Registration of Ordinary Cosmetics (Issue 54)". It clarified that

-the registration requirements for multi-color cosmetic products, such as eyeshadow palettes, that have non-separable packaging containers. These products should be registered as a single entity under one registration number, while the formulas for different shades should be reported separately. Individually packaged products with different shades should be registered separately, with each shade assigned a unique registration number.

-When toxicological tests are not exempted, products that may come into contact with the eyes, including facial cleansers, shampoos, rinse-off conditioners, eye products (excluding eyebrow cosmetics), and body washes, are required to undergo acute eye irritation tests.

-In cases of re-registering ordinary cosmetics after cancellation, a statement should be submitted, providing specific reasons for the cancellation, cancellation date, and highlighting any differences between the re-registered and canceled products.

 

On February 23, 2024, China NMPA issued a notification introducing the "Rules for the Application of Administrative Penalties in Drug Supervision and Administration," which includes provisions concerning cosmetics. The rules emphasize that when exercising administrative penalty discretion, drug regulatory authorities should adhere to principles of legal discretion, fair procedures, proportionality, fairness, combining punishment with education, and exercising comprehensive discretion. These rules will take effect on August 1, 2024.

International Cosmetic Regulatory Updates

On February 7, 2024, South Korea's Ministry of Food and Drug Safety (MFDS) implemented the "Regulations on Cosmetic Safety Standards and Related Provisions." This regulation explicitly prohibits the use of 1,2,4-trihydroxy benzene (Cas No. 533-73-3) in cosmetics. Products manufactured before the revision can be sold until October 1, 2024.

 

On February 9, 2024, India's Central Drugs Standard Control Organization (CDSCO) released the final version of the "Guidelines for Sampling Regulation of Drugs, Cosmetics, and Medical Devices." These guidelines aim to enhance and standardize national sampling procedures. They consist of 10 sections and 5 annexures, covering various aspects of sampling, such as sampling plans, sample selection, site selection, sample quantity, time schedule, and testing laboratories.

 

On February 22, 2024, Thailand's Food and Drug Administration (Thai FDA) announced proposed revisions to the country's cosmetic ingredient list. These revisions include several key adjustments to ensure compliance with the latest updates of the ASEAN Cosmetic Directive.

 

On February 23, 2024, India's Central Drugs Standard Control Organization (CDSCO) issued a notification requiring all registered importers of cosmetics in the country to submit an annual report detailing their imported products, starting from the date of registration authorization. This directive takes immediate effect and aligns with the provisions in the "Cosmetic Rules 2020." The report should include information such as the quantity of each batch or consignment mentioned in the bill of entry, the quantity and total cost of imported cosmetics in each batch, and detailed information on the warehouses where the products are stored for further distribution and sale.

 

On February 26, 2023, the Bureau of Indian Standards (BIS) published the "IS 4887 Specification for Paraffin Wax for the Cosmetics Industry (Second Revision)." This updated standard includes significant adjustments to the specifications and container labeling standards for paraffin wax used in cosmetics. Public consultations on this standard will remain open until March 12, 2024.
